As a nominated consultant, you may receive client information including company details, system information, documents and any materials submitted for an engagement. You must treat all such information as strictly confidential and use it solely for the purpose of delivering the assigned engagement. You are bound by the platform's Non-Disclosure Agreement and must not disclose, share or retain client information beyond what is necessary for the engagement.
You must deliver work that meets the acceptance criteria stated in the service description and order confirmation (the Statement of Work). Deliverables must be of professional quality, complete and submitted through the platform within the agreed timeline. Poor quality, incomplete or non-compliant deliverables may result in rejection, replacement or removal from the engagement.
Platform payments are held by LuDuan and are released to the consultant only after the client accepts the deliverables. Settlement is made by FPS bank transfer to the mobile phone number you provide at registration. By registering, you confirm that the mobile phone number you provide is a valid FPS-enabled number for receiving settlement payments. You are responsible for keeping this number up to date.
If the client disputes your deliverables and the platform determines, after review against the SOW criteria, that the deliverables do not meet the required standard, no payment will be made to you for that engagement. If a dispute remains unresolved, the engagement may be reassigned to another consultant without any payment to you.
Your commission is calculated on the engagement value less the Partner Introduction Fee (if applicable) and is linked to your average client rating. The first three completed engagements are paid at a flat 70%. From the fourth completed engagement the rate follows your average settled rating over your most recent 10 rated orders (rounded half up to one decimal place):
| 4.80 or above | 70% |
| 4.40 - 4.79 | 65% |
| 4.00 - 4.39 | 60% |
| Below 4.00 | 55% |
Acceptance releases your fee. The client must rate and accept your deliverables before the consultant fee is released. LuDuan reminds the client daily; if the client does not respond within five business days of delivery, the deliverable is deemed accepted, the order completes and your rating from the previous order carries forward. Deemed ratings count toward your average but never toward the removal count below.
Removal. A rating below 4.00 triggers a written notice. A second rating below 4.00 within the recent window deactivates your account immediately and opens a five-business-day dispute window: reply with your evidence and admin will uphold or void the rating (voided ratings are excluded from all calculations). If the dispute fails or is not raised, you are removed from the consultant list. You may dispute a rating within five business days of it being submitted.
Worked example: an engagement is listed at HK$10,000 with a Partner Introduction Fee of HK$2,000 (if applicable). The commission base is HK$8,000 (HK$10,000 less HK$2,000). At an average rating of 4.8 your fee is 70% of HK$8,000 = HK$5,600. Where a partner introduced the engagement, the partner commission is deducted from the net first and your tier applies to the remainder.
LuDuan may reassign an engagement to another consultant at any time (including after assignment). If you are replaced, you will be notified and must stop all work on that order immediately. You will not be entitled to payment for an engagement that is reassigned, except for work completed and accepted before reassignment, as determined by LuDuan.
LuDuan has the ultimate right to judge the quality of deliverables, the validity of client disputes and the outcome of any disagreement regarding an engagement. You agree to accept the platform's determination as final.
This Agreement forms part of the LuDuan legal framework together with the NDA, Data Sharing Consent, Disclaimer, Service Terms and Refund Policy acknowledged by clients. In the event of any conflict, this Consultant Service Agreement prevails in respect of your obligations as a consultant.
